Welcome to My Coffee! These Terms of Service ("Terms") govern your use of the My Coffee mobile application and website (collectively, the "Service") operated by My Coffee ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Acceptance of Terms
By creating an account or using My Coffee, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service.
2. Eligibility
You must be at least 13 years of age to use this Service. By using My Coffee, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Termination
You may delete your account at any time by contacting us at support@ratemycoffee.app. We reserve the right to suspend or terminate your account if you violate these Terms.
4. User Content
4.1 Your Content
Our Service allows you to create, post, and store content, including coffee reviews, ratings, and notes ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content.
4.2 License Grant
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with operating and improving the Service. This license includes the right to:
- Display your reviews within the app
- Generate aggregated, anonymized statistics from review data
- Use aggregated data to provide insights to coffee shops (without identifying individual users)
4.3 Content Standards
You agree that your User Content will not:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Contain defamatory, obscene, or offensive material
- Contain false or misleading information
- Harass, abuse, or harm another person
- Promote illegal activities or substances
- Contain spam, advertising, or promotional content
4.4 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is objectionable.
5. Acceptable Use
You agree not to use the Service to:
- Violate any local, state, national, or international law
- Transmit any viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use any automated system, including bots or scrapers, to access the Service
- Collect or harvest any information from the Service without authorization
- Impersonate any person or entity or misrepresent your affiliation
- Use the Service for any commercial purpose without our consent
6. Intellectual Property
6.1 Our Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of My Coffee. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.
6.2 Feedback
If you provide us with any feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback for any purpose.
7. Third-Party Services
Our Service may contain links to or integrate with third-party websites and services, including map and location services (such as Google Maps). We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OF INFORMATION
We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy of coffee shop information, ratings, or any other data provided through the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY COFFEE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption or computer damage
- Cost of substitute services
Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us, if any, in the past twelve (12) months.
10. Indemnification
You agree to defend, indemnify, and hold harmless My Coffee and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any rights of another party
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
13. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If such efforts fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Coffee regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
